This High Court action is being supported and endorsed by Tuariki Delamere who developed and introduced the Long Term Business Visa policy in 1999 when he was the Minister of Immigration.

As the author of the Long Term Business Visa policy, Mr. Delamere feels a sense of obligation to make it right and just for those LTBV holders who have been suffering from the unjust action of the government.

A Legitimate Expectation
Long Term Business Visa holders were promised a resident visa if:
1.They established the business described in their business plan
2.Their business was profitable
In December 2013, the Government added a new requirement for the resident visa:
•The business must have sales greater than the sales forecasted in the business plan.

STATEMENT OF the IMMIGRATION MINISTER
“People who are on a Long Term Business Visa and who are ready to apply for residence under Entrepreneur category will still be able to do this. This is because the Entrepreneur category is not being revoked. It will be renamed and SLIGHTLY AMENDED in March 2014. The main change will be that the Entrepreneur Plus category will be disestablished and included in the Entrepreneur Category, but this will not disadvantage any Long Term Business Visa holders transitioning to residence.”
Slightly Amended
Adding in a new requirement that your business must achieve sales that exceed your business plan is not a slight amendment. For many, it was already impossible to meet.
This will not disadvantage any Long Term Business Visa holders
Hundreds of Long Term Business Visa holders were disadvantaged when this new amendment was introduced because they had been operating their business for 2 years and their sales were less than their original forecast.

STEP 1:A LEGAL OPINION
Before we file proceedings in the High Court, the lawyer will research the case and provide a Legal Opinion Report on the chances of success. She will also provide a cost for preparing the case, for filing in the High Court, and for appearing in Court.
The cost for participation in Step1 is $1,000+GST
Step 2 :Filing in the High Court
If the lawyer recommends going ahead with the case then contracts will be prepared for every LTBV holder who wants to participate. It is estimated the cost for Step 2 will be about $4,000 to $6,000. However, the actual cost will depend on the numbers who join this case.
Step 3 :Negotiations
with the Government Once the proceedings are filed in the High Court we will seek to open negotiations and settle this case without having to have an actual trial in the High Court. This is a very realistic possibility as the Government will not want to risk losing in the High Court. If we can do this the case could be settled quickly – probably before the end of the year.

第三步:与政府谈判
⼀旦向⾼院提起诉讼,我们将寻求与政府的公开谈判以及庭外和解。由于政府并不想冒险在⾼院输掉官司,庭外和解⾮常切实的可能。若我们能够达成此愿,这个案⼦也许可以在年底尘埃落定。
